The Committee on  the Judiciary moves to amend the title of the bill to read as follows:

Strike and Insert for S. B. 475 - “A Bill to amend the Code of West Virginia, 1931, as amended, by adding thereto two new sections, designated §19-12E-10 and §19-16-3a, all relating generally to industrial hemp; creating an Industrial Hemp Research and Development Grant Fund in the State Treasury, administered by the Commissioner of Agriculture, and funded by fees and appropriations; establishing for appropriation by the Legislature; setting a fee schedule based on size and use of land where industrial hemp operations are conducted; requiring the commissioner to transmit collected fees to the State Treasurer for deposit in the fund; providing for administration of an Industrial Hemp Research and Development Program to private companies and state institutions of higher education to conduct research related to commercial purposes of, and breeding programs for, industrial hemp; creating the Industrial Hemp Research Fund in the State Treasury consisting of fees, private moneys or other funding for hemp research; creating an industrial hemp seed certification program, consistent with state and federal law; establishing the program may  include West Virginia landrace cannabis seed; defining West Virginia landrace cannabis seed; permitting holders of an industrial hemp license to obtain a license for the development of industrial hemp varieties for certification; authorizing imposition of a fee to be determined by the commissioner to operate and administer the seed program; and, providing for emergency and legislative  rules to  implement the hemp seed certification program.”
